Taking Security - Loan Agreements and Charging Property

Taking Security against Property

A legal charge registered against a borrower's property allows a lender to protect the money they have lent to an individual or company. The charge usually prevents the borrower from selling or disposing of an interest in their property until the debt and charge are discharged. 


In the event that the borrower breaches the terms of the loan agreement enforcemen action to secure the outstanding loan amount can be taken against the charged property to seek full repayment of the sums owed.
